separately, president trump is still considering sending national guard troops to chicago over -- against the wishes of jj.b. pritzker. is he saying as ice enforcement is going to ramp up there over the coming days based on the staffing there and some of the facilities that are being built. temporary facilities in chicago. he wants all chicagoans taking phone, videos and pictures of all federal agents every chance that they can. something else that broke while we were coming to air, president trump tomorrow, according to our colleagues at fox digital, is planning to sign an executive order remaining the defense department the department of war, that is something that congress needs to get involved with so part of this order is ordering the defense secretary pete hegseth to propose a legislative absolute solution to make the change permanent, aishah. >> okay, peter doocy with that late breaking news for us, peter, thank you. tonight, the trump administration is warning venezuela that more strikes,

submit a joint status report on the case at a hearing in december. it appears alligator alcatraz is back in business tonight. an appeals court has stayed an injunction that barred the state of florida from aggravated to the illegal immigrant detention site and also ordering it closed. florida's attorney general says that the facility never officially closed and this new ruling allows officials to start bringing in more detainees. a college professor in california tonight is facing serious charges accused of throwing a tear gas canister at federal agents. it allegedly happened during a protest over an immigration enforcement action at a los angeles county marijuana farm. correspondent matt finn has details tonight from los angeles. >> a federal grand jury indicted california state university professor jonathan carvel low for assault on a federal officer. during massive immigration

enforce wanted marijuana farm north of l.a. this summer. federal investigators say he threw tear gas canister at agents and physically resisted arrest. the feds say the call state philosophy and matt lecturer blaring a megaphone at border agents. carvel low in a blue floral shirt. agents used tear gas canisters to push back agitators and that's when he turned around, ran towards the canister and picked it up and threw it overhand back at agents. the canister came within several feats above law enforcement's heads. the feds say carvel low had on the blue shirt then changed into a pink shirt to disguise himself kicked legs and refused to give agents his arms after arrested. after caravello taken into custody the faculty claims he was kidnapped by ice and wrote: we strongly condemn the abduction of california faculty association professor, member and activist jonathan a.

caravello and other community members terrorized and arrested by federal immigration authorities. while exercising their constitutional rights to protest peacefully. but the feds say the professor was not abducted, rather arrested, held for a few days and released. he is free on $15,000 bail and faces up to 20 years in prison if convicted. and this afternoon, cal state tells us that caravello is still employed and teaching. the school tells us it is aware of the grand jury indictment and is honoring the legal process. aishah? >> aishah: okay, matt finn live for us in l.a. matt, thank you. meantime, in oregon tonight, the immigration and customs enforcement facility in portland has become the scene of demonstrations for more than 80 consecutive nights. correspondent dan springer shows us this evening. >> night after night, this is the scene just outside the ice facility in portland. hundreds of residents live in

apartments just feet away. they routinely call police about the noise and crime. [siren] >> calling about the -- they cornered two women out here. they need help. please send the cops. >> but the cops did not come. residents on their own. [shouting] down, it's midnight. we the people need sleep. >> this week protesters brought what looked like a guillotine. some confrontations end with residents getting assaulted. first a bullhorn, then a fist. no arrest was made, despite the injuries. [sirens] >> on this late in late june federal police used tear gas and flash bangs, again, no portland police in site it. came out later in court that one officer told another if it were not ice, we could assist directly. julie parish sued the city to enforce local laws. this is a full on abdication of police duty in a four block radius that impacts some of the most vulnerable oregonians that we have. we will let violent rioters do

states as a way to project what is a very aggressive foreign policy, which you know, there are a lot of questions is that foreign policy really aligned with the united states. >> bret: some people look at that as saying trying to buy influence or make unfor something you're doing in the region? how do you address that? >> well, it's really unfair accusations for qatar trying to buy influence. throughout, you know, the last 225 years or 30 years you will find qatar by the side of the u.s. in many areas and many things. are. >> bret: they like to be the mediators, do you think their intentions are good? >> i mean, i stew over this to be honest. a lot of people do. they have gotten some of the hostages out. if you look at it on a positive note, they helped americans get out of afghanistan, but i do think they empower groups in a lot of instances that are not our friends. >> bret: lawmakers on both sides of the aisle expressed unease

senator barrasso a member of leadership expressing concern. that was. the best one was senator cassidy and he framed it as hey do you think president trump was worthy of the nobel prize for operation warp thunder and the answer rfk was yes. where do you stand on the vaccines for covid-19. got mixed up. i think -- so i think -- step back from the hearing. vaccines are popular, vaccines are needed and rfk is better when challenging the authority of mandates. but when he challenges vaccine is he really on thin ice. that's where the president comes. in the president comes in and says hey, well, i don't know, covid-19 operation warp speed was to my advantage and that makes it difficult for him. >> aishah: polling came from the white house because getting into the midterms fight here. juan, one of the things that, as roger mentioned that, democrats

grilled him on was the president's operation warp speed program and the covid vaccine. and he talked a lot about how he supported the operation, but then sort of paused on the vaccine and he blamed the data chaos from the biden administration and the lack of accurate data. how did you see that? >> well, i thought the point here, in terms of the conversation, aishah, was that they said to him, didn't did you go on the record and say that you thought the covid vaccine had killed more people than covid, than the disease itself? and he really didn't be have -- how do you respond to that because he is on the record as having said that. so, to pick up on what roger was saying, i thought that the republican senators and that's the biggest development of this day, by the way, that you saw republicans pushing back on secretary kennedy, you can't just say this was a purely political attack because you have republicans engaged in saying that they have doubts

about his leadership. >> aishah: there was a republican, senator marshall a republican was trying to help him out a little bit explaining you can believe in two things at the same time. you can support operation warp speed and then look at the covid vaccine in today's atmosphere where, you know, we know new things about it. so, do you want to recommend it blanket across the board to all americans or do you want more data and research? >> juan: well, but the question that came from dr. senator cassidy was, okay, everybody is open to questions but why are you canceling $500 million contract to look into the efficacy of these vaccines? why are you saying that the vaccine killed more people than a disease? so, those are questions that are legitimate, and they are coming, again, i think today, the major development is the g.o.p. pushing back on kennedy.

>> aishah: the white house seems to be supporting their health and human services secretary still. this is j.d. vance, the vice president on x writing when i see all these senators trying to lecture and gotcha bobby kennedy today. all i can think you support off label, untested and irreversible hormonal mutilating our children pharma. you are full of, i won't say the word and everybody knows it. what are sources telling you about what is going on inside the white house and their view of all of this. >> the big question surrounding maha was if and when president trump would yield to outside pressure and reign in rfk jr. look, if maha was just about banning food dyes or making gym class again again we wouldn't see controversies. what we saw on capitol hill is a secretary very confident in his mandated. my sources at the white house and over at hhs they say kennedy came loaded forebear. he knew he was going to face criticism not just from democrats but also republicans. what they're counting as a win

right now is they believe he was able to deflate this controversy about the fired cdc director being fired not for standing up for science, but for leaking to the press. so, in their mind, they think went well. and that tweet from the vice president is validation. >> aishah: they are also celebrating this new turn around on the war on drug, quite a site, this video that came out of the drug cartel vessel being bombed. they are going after the cartels in their own backyard, it's something we have never really seen before, roger. >> jen griffin had a great spot on ethearlier debating the legaf the strike. a lot of noise on capitol hill. we have already seen that president trump is on good authority on the article 2 authority of the constitution. but what is missing is a lot of the facts and details who was on, what they were seeking to do represented a threat. the larger point is president trump is saying we're shifting the paradigm from law enforcement to this being a military problem. >> this is a continuing

advocated in the first administration trump 45. contemplating missile strikes against cartels in mexico. he had on this in january. this is something he has been developing for some time. i think it's responding to what the electorate want. i think there is legal justification. more facts out there to really validate that and people see it from the department of justice. >> aishah: juan, quickly, this is what republicans wanted joe biden to do and he didn't do anything. >> juan: well, to me it invites questions, aishah, so most fentanyl comes from china. would you bomb a chinese ship? what about mexico, our neighbor? lots of drugs come through there, are you going to send the military in? boy, that has real consequences. >> aishah: they have labeled this particular cartel a terrorist organization, the legal causeway they are using. a few more seconds here for you, phil. >> the president wasn't pushing paper around when he designated these cartels as terrorists. i think this is the updated monroe doctrine.

the white house feels this is our hemisphere and going to be going after these cartels not through the legal system but through the u.s. military. it sends a deterrent not just to the maduro regime but wayward allies. you don't want seal team 6 in backyard cooperate with us. that's what secretary rubio was able to accomplish with security gawshts in mexico. >> aishah: always run out of time when the conversation was getting good. juan, i was going to give you more time. sorry about that. thank you, guys.
